1.1 These terms apply when you submit content related to fashion, restaurant, food & drink, culture, arts, education, real estate, interior design, technology and any other to Coconut Grove Magazine. Content may include text, images, photos, videos, plans, drawings, renderings, virtual tours, sketches, or any other content you provide.
1.2 By submitting content and ads, you agree to these terms and the licensing of your content (as described in section 1.3) will be established between you and us.
1.3 In accordance with section 1.2, you grant us a non-exclusive, worldwide, irrevocable, perpetual, transferable, sub-licensable, paid-up, and royalty-free license to use, publish, reproduce, display, or otherwise exploit the content you submit to us, in whole or in part, for any purpose we determine necessary (including on our websites, mobile and tablet applications, social media pages, advertising, marketing, promotional works, and publications, as well as allowing third parties to publish the content in association with us).
1.4 You acknowledge and agree that we will not pay you a fee for the content you submit. In exchange for providing the content, it may be featured on our websites and in publications, or used, published, reproduced, displayed, or otherwise exploited for any other purpose as explained in section 1.3.
1.5 You recognize and agree that we are entitled to:
Edit, adapt, and make changes to the content you submit without prior approval (for example, correcting errors, ensuring text conforms to our style, shortening videos or movies, or cropping images).
Decide not to use, publish, reproduce, display, or otherwise exploit the content you submit.
Remove any content at any time from our websites, mobile and tablet applications, social media pages, advertising, marketing, promotional works, or publications.
1.6 By submitting content, you legally promise (warrant) that:
The content does not infringe on any third party rights (including copyright and trademarks) and does not violate any laws.
You have the right and authority to license all existing and future intellectual property rights in the content.
You have informed us, if applicable, of any necessary credits to be used in conjunction with the content and signed our photo release forms if applicable.
The content is not abusive, obscene, illegal, defamatory, libelous, factually inaccurate, unlawfully threatening, unlawfully harassing, pornographic, racist, or likely to incite racial hatred or acts of terrorism.
The content is free from viruses, Trojan horses, worms, time bombs, keystroke loggers, spyware, adware, cancel bots, or other harmful computer programming routines.
1.7 Lead times and print deadlines: The actual deadlines may vary from the Media Guide deadlines. The client has the right to withdraw 3 weeks prior to printing deadline. The withdrawal must be in writing within 5 days of the insertion conformation and receipt of payment.
1.8 Cancellations of ad placement: The client may cancel for any reason in writing prior to the printing deadline. In a case of cancellation, the client shall pay the following costs: if Coconut Grove Magazine receives the cancellation at least 4 weeks before the print deadline, 50% of the order value, if the order is less than 4 weeks, 70% of the order value and if cancellation is received after the print deadline, 100% of the order value.
1.9 You agree to promptly notify us in writing by email at coconutgrovemagazine@gmail.com if a third party threatens or makes a claim that the content infringes their rights or any other claim related to the rights granted in section
1.10. You agree to provide us with any assistance we may reasonably require concerning such claims.
1.11 You agree to indemnify us against any liabilities, costs, claims, damages, losses, and expenses arising from a breach of the warranties in section
1.12 (including but not limited to any claim or action against us regarding infringement of third party rights) and from not notifying us in accordance with section 1.7.
1.13 You hereby waive all moral rights under the Copyright Act of 1976 (and similar rights in other jurisdictions) that you have permissions and own the rights to the content you have submitted to us.
1.14 We will collect and process information and personal data relating to you in accordance with our privacy notice, which can be accessed at coconutgrovemagazine.com/privacy-notice/.
1.15 We update these terms regularly. Once the terms are established between us (as stated in paragraph 1.2), please review them before submitting content to ensure you understand the current terms. The most recent update to these terms was on July 1, 2026.
1.16 You agree to promptly complete and submit any necessary documents and actions to fully comply with these terms, or make reasonable efforts to ensure a third party does so.
1.17 These conditions shall be amended or removed to the extent required to restore their validity and enforceability in the event that any part of them is found to be unlawful, invalid, or unenforceable.
1.18 Lead Times: 3 weeks prior to closing.
1.19. Cancellations of orders by client: The Client may cancel Order in writing by email prior to the booking deadlines, which is 3 weeks before closing. If we receive a cancelation in less than 3 weeks notice, 50% of the order value will be due.
1.20 Quantities / Residual stocks may very due to fluctuations in the number of advertisers and payments timing.
1.21 These terms, including any disputes or claims related to them, are governed by the laws of Florida.
1.22 Any disputes or claims related to these terms will be settled in the courts of Florida.
Coconut Grove Magazine does NOT accept:
Political Opinions
Public Policy Commentary unless in an unbiased manner.
Do Not accept any release that is solely for the purpose of airing grievances or slandering an individual or company’s reputation.
Explicit Content that contain any sexually explicit or mature content.
Redistributed articles.
Copyrighted content obtained without permission.
Stock sales or purchases, stock tips, advice and alerts.
Malicious or threatening content, violent in any form, violent acts of any kind.
All content must be free of bigotry, racism and hatred.
Unethical SEO practices and competitor mentions.
Coconut Grove Magazine reserves the sole right to accept or decline any advertisement, promotional content, sponsored content, or directory listing at its sole discretion. This includes, but is not limited to, submissions from advertising, marketing, public relations, branding, media, SEO, social media, publishing, or similar agencies, as well as any business whose products or services directly compete with those offered by Coconut Grove Magazine or its affiliated companies.
